Terms of Service

Please read these Terms of Service ("Terms") carefully before using the RunTuner mobile application or website (collectively, the "Service") operated by RunTuner ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We reserve the right to verify your age and to terminate accounts of users who do not meet the eligibility requirements.
2. Accounts
- You must provide accurate and complete information when creating an account and keep this information up to date.
- You are responsible for maintaining the confidentiality of your login credentials. Do not share your password with any third party.
- You are responsible for all activities that occur under your account. Notify us immediately at runtunerapp@gmail.com if you suspect any unauthorized use of your account.
- Each account is for individual, personal use only. You may not share your account with others or create multiple accounts for the purpose of circumventing subscription fees.
3. Subscriptions and Payments
3.1 Free and Paid Plans
RunTuner may offer a free tier with limited features and paid subscription plans ("Pro Plans") that unlock additional features. The current pricing and features of each plan are displayed within the app.
3.2 Billing
Paid subscriptions are billed through the Apple App Store in accordance with Apple's payment terms. By subscribing, you authorize Apple to charge the applicable subscription fees to your payment method on file with Apple.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
- You can manage and cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
3.3 Free Trials
We may offer free trial periods for paid plans. At the end of the free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. Any unused portion of a free trial period is forfeited when you purchase a subscription.
3.4 Refunds
All purchases are subject to Apple's refund policy. We do not control refund decisions for App Store purchases. You may request a refund directly from Apple.
3.5 Price Changes
We reserve the right to change subscription prices at any time. If the price of your subscription increases, we will provide you with advance notice by email or in-app notification. Your continued use of the Service after the price change takes effect constitutes your agreement to pay the updated subscription price.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable local, national, or international law or regulation.
- Transmit any unsolicited or unauthorized advertising or promotional material.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Attempt to gain unauthorized access to any part of the Service or its related systems or networks.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service in any way that could disable, overburden, or impair the Service or servers.
- Use automated means (bots, scrapers, etc.) to access or collect data from the Service without our express written permission.
- Upload or transmit any viruses, malware, or other malicious code.
- Use the Service for any commercial purposes without our express written consent.
5. Medical Disclaimer and Health Advice
RunTuner is a fitness coaching application and is NOT a medical service or product.
- The training plans, coaching advice, and other content provided through the Service are for general fitness and informational purposes only and do not constitute medical advice, diagnosis, or treatment.
- Always consult a qualified physician or healthcare professional before beginning any new exercise program, especially if you have a pre-existing medical condition, injury, disability, or are pregnant.
- Stop exercising and seek medical attention immediately if you experience pain, dizziness, shortness of breath, or any other unusual symptoms.
- User-provided health data (age, weight, fitness level, etc.) is used solely to personalize your training experience and should not be substituted for professional medical evaluation.
- We are not responsible for any injury, illness, or health complication that arises from following training plans or advice provided by the Service.
6. Intellectual Property
The Service and its original content, features, and functionality (including but not limited to text, graphics, logos, software, and AI-generated training plans) are and will remain the exclusive property of RunTuner and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service or its content, nor may you reverse engineer or attempt to extract the source code.
By submitting any content (e.g., feedback, comments) to us, you grant RunTuner a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute that content for the purpose of operating and improving the Service.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy, which describes how we collect, use, and share information about you when you use the Service.
8. Third-Party Services
The Service may integrate with or link to third-party services, including Apple HealthKit, the Apple App Store, and AI model providers. Your use of such third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements or expectations.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RUNTUNER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE;
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
- ANY CONTENT OBTAINED FROM THE SERVICE; OR
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50 IF YOU HAVE NOT MADE ANY PAYMENTS.
11. Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:
- Your right to use the Service will immediately cease, and your access to your account data may be restricted.
- All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
- You may delete your account at any time from the app settings. Upon account deletion, your personal data will be deleted in accordance with our Privacy Policy.
12. Apple App Store Additional Terms
If you download or use the Service through the Apple App Store, the following additional terms apply:
- These Terms are between you and RunTuner only, not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
- Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Service.
- In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.
- Apple is not responsible for addressing any claims you have or any claims of any third party relating to the Service, including: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the Service or your possession and use of the Service infringes a third party's intellectual property rights, RunTuner (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.
Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be resolved through binding arbitration or, where arbitration is not available, in the competent courts of the jurisdiction in which RunTuner operates.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, for significant changes, by sending you an email or displaying a prominent notice within the app. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
